Relief for Sakaja as High Court Suspends CUE’s Decision To Revoke Recognition Of University Degree

The decision of the Commission for University Education (CUE) to withdraw the validity of Nairobi Senator Johnson Sakaja’s university degree has been temporarily stayed by the High Court awaiting the outcome of his lawsuit and a hearing on the matter.

In his judgement, High Court Judge Jairus Ngaah prevented the Independent Electoral and Boundaries Commission (IEBC) from removing Sakaja’s name off the list of candidates who have been given permission to vie for the post of Nairobi Governor.

Senator Sakaja has taken legal action in order to contest the decision made by CUE to remove recognition of his university degree. He said that the decision was made unjustly and in favor of his political opponents.

The Senator for Nairobi indicated that the judgment made by the commission was hasty, and he added that the topic about his academic credentials to run for the Governor race is still being investigated.

Sakaja, with the assistance of his attorney Elias Mutuma, argued that the decision by CUE to remove recognition of his degree breaches his rights to a fair administrative procedure and a fair hearing.

Sakaja included a copy of his degree certificate from Team University as well as a letter from the university’s Executive Director informing him that he had enrolled in the Bachelor of Science in Management program through the university’s Distant Learning program and had graduated on October 21, 2016.

Earlier on, the Dispute Resolution Committee of the IEBC rejected three complaints lodged against Senator Sakaja for lack of prosecution. This was done since the complainants failed to appear in court.

CUE announced on Wednesday that it will launch an investigation into the legitimacy of the documents that Senator Sakaja presented to the IEBC in order to be granted clearance to run for office. This comes after CUE revoked its recognition of Sakaja’s Bachelor of Science in Management Degree from Uganda’s Team University.
